And it was another campaign promise, that taxes wouldn’t be raised on those earning under $250,000 a year, that prevented a path to the same goal through the tax code that would do essentially the same thing as the existing individual mandate. Decision surrounding taxes are subject to the lowest standard of constitutional scrutiny, the rational basis standard. I’ll defer to Jeff Goldblume’s character in The Big Chill as to the ubiquitous nature of rationalizations, which is about all that’s needed to meet that constitutional test.
